Criminal Record Check....

Curious about this question...As far as criminal record checks go for employment purposes I know there are 4 sections. the first 3 will go into detail about any convictions etc. you have and the 4th section basically deals with "negative contact with police." As far as that negative contact with police situation goes if you have any negative contact with them from what I am told they write "maybe, maybe not" on your check. Now when the employer calls you do you need to disclose the information to them? Can they use it against you? It isn't a conviction afterall. The negative contact with police includes possession of marijuana, assault, etc.

No you do not have to disclose anything. The employer will not even question. The main thing is you have no convictions

Question: Does a person have a criminal record only AFTER being convicted?

Or, do u have something on your record even if you've been charged/summoned

innoncent until proven guilty. If you haven't plead or been found guilty you wouldn't have a record.

You have a "file" with all charges and other police interactions on it that the police can reference however Criminal Record is only something that you have been convicted in a court of law for. If you have been charged with something and gotten not guilty or a stay of proceedings it is NOT on your record. Also if this happens you can appeal to the police department to destroy the fingerprints and photo identification they took when you got booked.

^ not entirely true. for my current job i had to submit a criminal record check. on there was times i called the police when there was an altercation with my friends and another group.

Yes, the check also includes negative interactions with the police.

So, is it true, that if you have a criminal record you can't get a job anywhere? Unless its like Burger King? LOL - I know a few old high school douches that have records (minor shit like theft) and are currently flipping burgers.

Well, if you are charged as a minor, it will be wiped clean when you reach adulthood.

So, will a Criminal Record check show "pending charges", things that you have NOT been convicted of yet? And if so, does it show in detail?

No only convictions however this whole "negative interactions" things is a new thing to me. If that's the case.... I'm gonna need a binder for my record check.

When I got a criminal record check for my job (security-related), I just went to the police station and filled out a form... part of that form, if memory serves, regarded what sort of purpose the check was for. I would expect that different levels of information are given by the police depending on the need - my guess would be that there are specific guidelines for what jobs/uses require what level of detail. I don't remember if I had anything under that section, I just know it all cleared fine for the job. A friend had to get one done when he volunteered to work with minor hockey as well, something that I expect would require less of such detail than, say, a job as a corrections officer or something.

They have 4 sections...
2 are for convictions serched under 2 systems...one for outstanding charges and one for negative interaction

i went to burnaby rcmp...don't know if that makes a difference

^^ Its not called a record in the "Criminal Record" sense of the word. Its on file but not a record ie. it can't stop you at the border.

Yeah thats what I meant. If they do you a criminal record search they dont just look for actual convictions. You will have a 'file' where it states that you were charged with an offense.
