| Dealership claims car has no accident but has ICBC claim?
hi guys,
I recently bought a car from the Richmond automall and on the contract it clearly states that the car has no accident. Since its a prestigeous dealership I didn't have a doubt about it and went in and bought the car. However, after a week the car has been nothing but trouble, which made me suspecious that the car has been in an accident. So I went in and asked for a ICBC report. And on the report it says the car has got an $1750 vandalism claim, which is not really a traffic accident but I would still consider it an accident..who knows whether the vandal has anything to do with the car's mechanical structure or not?
anyhow, can I take this legally and say the dealership is fradulent? please give me some insights.

An accident indicates that the car was involved in a crash of some sort. An ICBC claim most likely means it's something along the lines of a windshield/side window being replaced, or a body panel being repainted due to an act of vandalism/inconsiderate owner smashing their door into the other car/etc.
So, no, it's not considered an accident and trying to claim the dealership is giving you fraudulent information is going to make them not want to deal with you.

A $1750 vandalism repair is peanuts. I can do over $2000 damage to a car with just my bare hands and feet.
When you have claims of $5000+, THEN you can start worrying.

What kind of problems are you having on your car? I think what you should do is actually go to the dealership that the car normally got serviced by the previous owner and ask for a service record. See if there are any clues that would point toward the problems you're encountering now.
Good luck and hopefully your car still has some warranty left.

I know that Cowell motors in the Automall usually show a declaration sheet to their customers when they purchase a used car.

I don't see how a vandalism claim would cause problems with the car.... but yah what they said above, you don't have to say anything to anyone unless it's over $2,000 and then you are required by law to report it to the next buyer....... and even then, I think the $2,000 number should be raised, these days the headlight for a Maxima is almost that much let alone an actual "accident" claim.

its more about where it was fixed and the circumstances, not so much the $$ amount... but in this case, $1750 in vandalism will likely be maybe a replaced body panel and some paint? maybe new light, paint, window?? nothign that would affect hte car majorly....

also, buying a second hand car is like playing russian roulette, regardless of where you buy it from, you need to find out as MUCH as possible before diving in, because once you buy it, its all yours

Complain to BC New Car Dealers http://www.newcardealers.ca/ That's what they are there for.
But before you complain. you should have in mind what kind of recourse you want from the dealer. No use complaining if you don't want from them in the first place.
You should do CarProof etc before you buy any used car dealership or not from a dealership.

I am sure the person who vandalize the car didn't do it by accident.

1750 is most likely a smashed window. What you consider is irrelavent.
You need to be more specific on what you meant "nothing but trouble"

Yeah, $1750 is barely anything for most cars. My friend had his windshield smashed by some douche kids on one of those pedestrian overpasses a year or so ago, and it cost $1200 for the glass alone (from the dealer, but nevertheless). Rain-sensing glass is priiiicey.

On the flip side, just because ICBC has no record doesn't mean the car wasn't in an accident.
The driver could have fixed the car themselves for many reasons. Driving drunk, too many claims already or some other reason.
This is why you should get any used car you plan on buying checked over. If you like the car, then spend the $100-$150 to have someone look at it. Doesn't matter how "prestigious" the dealer is.

What kind of damage would a 05 g35 coupe ha sustain in the worst case scenario if there's two claims on the car one for 2k and the other for 3k.
Mostly cosmetic and not mechanical right?
