| Got hit last night
Hey guys,
Unfortunatley while I was at work last night my car was backed up into by 3 guys who had a couple of drinks. They're not local, but they were nice enough to come back in and give me his information after he hit the car.
He has a International licence and was driving a rental car. What is the best way to settle this?
Do I have the right to contact him and try to resolve this privatley. ie, Get a estimate from the shop and have him pay the amount? And what if he refuses this? I don't want to pay deductables on something that not my fault in any way shape or form.
Dealing through ICBC, I heard its a huge hassel and I really don't have the time to bring the car to them on my days off etc.
Anyways, the damage isn't too bad, Broken Tail light, fender flares scratched and rear bumper scratched and cracked as well.

If you're found 100% not at fault, I don't believe you have to pay any sort of deductible. I don't think Morgan had to when the lady hit his car in the underground parking lot a couple months ago.

He will have to pay the deductible. If he leaves the country, I think you are SOL though.

I would file it with icbc. If the guy that hit you doesn't lie about the situation, you shouldn't have to pay a thing.

Was your car parked (nobody was in your car)?
If they hit your parked car and they don't screw around with ICBC, you won't pay anything out of pocket. This assumes that you have collision or comprehensive coverage. If your car was parked, I think it's a comprehensive claim.
You will be out lost time/inconvenience and maybe cost of a rental car while yours is in the shop (this depends on the shop that you rent from, and particular ICBC coverages).

when someone hit me in a parking lot (me in the car, 100% other person's fault) i didn't have to pay anything out of pocket. all the deductible does is allow express claims. so you pay the deductible up front to get the car into a shop, and then if you are found not at fault by ICBC they refund your deductible.. not 100% sure, but just call ICBC and ask...

Calling ICBC will prevent any private deals goes "out of plan". If your private deals goes well, you can just tell ICBC that you have settled the claim privately and ICBC won't require you to pay any deductibles (as they didn't repair your vehicle). If your deal goes bad, then ICBC will chase down those people for you. Either way, its best to contact ICBC about this.

^^I agree. The only reason NOT to go through ICBC is if you drive a relatively nice car and you don't want to have a claim on file affecting resale value. This is assuming the damage is minor.
