The future-friendly, animal-mascoted phone company headquartered in a shoe in Burnaby is suing Rogers for their ads. Specifically, the ones that claim Rogers is the fastest around with the best network quality.

Telus Communications Inc. (T-T33.600.300.90%) has launched legal action against Rogers Communications Inc. (RCI.B-T32.88-0.26-0.78%) , claiming its advertisements boasting of Canada's fastest and most reliable network are false and misleading. In documents filed in B.C.'s supreme court, Telus said that since a Nov. 5 upgrade, a network run by Bell and Telus offers faster and more reliable service than the Rogers network. Telus says Rogers ads introduced in 2007 and continuing after Nov. 5 that claim Rogers provides “Canada's fastest network: two times faster than any other,” are now false and misleading. Telus is seeking a declaration from Rogers that its ads breached Canada's Competition Act, as well as an injunction from distributing the ads, damages and compensation. “We stand behind our claims,” Rogers said in a statement. “All of our internal and third party external testing since 2007 has consistently demonstrated that we have the most reliable network. We’ve established our reliability over time with millions of customers on our network. Telus has not submitted any data on their network performance. We look forward to vigorously defending our position in court.”
