The future-friendly, animal-mascoted phone company headquartered in a shoe in Burnaby is suing Rogers for their ads. Specifically, the ones that claim Rogers is the fastest around with the best network quality.

Telus is seeking a declaration from Rogers that its ads breached Canada's Competition Act, as well as an injunction from distributing the ads, damages and compensation. “We stand behind our claims,” Rogers said in a statement. “All of our internal and third party external testing since 2007 has consistently demonstrated that we have the most reliable network. We’ve established our reliability over time with millions of customers on our network. Telus has not submitted any data on their network performance. We look forward to vigorously defending our position in court.”

I kinda wanna see how this turns out, but if Telus can't come up with proof against Rogers' speeds, they got no case.

but I've seen many speed tests around that claim Telus IS faster than Rogers.

i bet you this came because of AT&T suing Verizon about their claim to be the most stable 3G network available with AT&T's network having very shitty coverage in the U.S. hahaha

I wonder how this will turn out in the Canadian Laws... AT&T's claim got rejected by the judge, but I think they have another re-trial in December (18th?) making it too late for a lot of Christmas cell phone buyers to switch over =P

Looks like Telus's lawyers convinced the judge that Roger's isn't the most reliable network.

In a move that surprised very few, a B.C. Supreme Court justice has granted TELUS a temporary injunction against a series of ads from rival carrier Rogers. As you might recall, it was on November 12th that TELUS filed suit against the Toronto-based company feeling that its ads touting “Canada’s most reliable network” with speeds “two times faster than any other” were “false, misleading, and harmful” to its business. Rogers admitted in court that it no holder holds the top spot when it comes to network speed thanks to TELUS’ newly-launched 21Mbps HSPA network, but it did argue and lost on the reliability front. Rogers has filed an appeal and vowed that “further steps will be taken shortly,” but has been ordered to return to court this Friday to discuss the pulling of the ads. Yes, friends, Canada is definitely different than the US
