can you still get VI'd when on day permit?

Mugen EvOlutioN 06-03-2010 07:08 AM

^

yes you can

Berzerker 06-03-2010 07:13 AM

You can VI anytime man. I had friend who had a cop wait an hour for him to come out of his friends house and gave him a box 1 for his exhaust when his car wasn't even running. He came out, cop said "Is this yours?" He said yes cop said I'm calling a Tow Truck because of reports of his exhaust being to loud.

The whole VI thing is the most brutal thing our legal system has towards our cars. The fact that an officer can give you a notice and order (VI) even as your driving out of a VI testing facility having just passed and there's nothing you can do about is the biggest hunk of horse shit in vehicle world.

Berz out.

See, this is what I'm talking about: bozos who just jump in and rattle off all sorts of idiocy without actually reading or paying attention.

Did you read the quoted article, at all? Did you even glance at it?

"On these days only, drivers will be offered an amnesty (no charges) by the police in North Vancouver. If their vehicle is found to be above the legal decibel limit, the Police will explain how to make the necessary improvements."

There's also nothing there about pulling anyone over - they're set up so people can come in and get their exhausts tested. IT'S VOLUNTARY.

Maybe if you think your exhaust has a problem you need to stop in there and have them check.

Only street legal and street safe motorcycles and vehicles will be tested.
I think they purposely made it vague about amnesty on other possible offenses. So what happens with other vehicles that are deemed illegal / unsafe? VI? All I'm saying is that it's possible for them to hand out VI's and tickets for other offenses but then again, that would be a huge dick move on their part so I'm not sure if they'd do it.

i ask the rcmp of what's the legal limit db for cars and this is their response.

There is a parallel approach for the topic of vehicle noise in BC.

First of all, it is the enforcement side: "No person shall drive or operate a motor vehicle propelled by an internal combustion engine equipped with a muffler or exhaust system to which is attached any device which increases the noise of the expulsion of the gases from the engine or allows a flame to be emitted from the exhaust system...No person shall start, drive, turn or stop any motor vehicle, or accelerate the vehicle engine while the vehicle is stationary, in a manner which causes any loud and unnecessary noise in or from the engine, exhaust system or the braking system, or from the contact of the tires with the roadway...The opinion of an inspector as to whether the engine and exhaust noise is greater than that made by other vehicles in good condition of comparable size, horsepower, piston displacement or compression ratio shall determine whether exhaust gases are expelled with excessive noise."

The Courts allow the enforcement officer's opinion as evidence if a vehicle's exhaust system is producing more noise than that of a similar model. A decibel meter reading is NOT necessarily required for a conviction.

The second approach is standard set for approved inspection facilities. The maximum allowable sound pressure level in DBA for light duty vehicles is 83 (not 84 and over), Motorcycles is 91, etc. These maximum allowable levels are specifically set for inspection facilities. The important point is a driver could still receive a violation ticket for excessive noise from the exhaust if in the enforcement officer's opinion that the vehicle's exhaust system is producing more noise than a similar model vehicle.

"What profiling?"

What profiling? You deny profiling exists on our streets when it comes to traffic and bylaws and their enforcement.
Sport compacts with aftermarket anything gets yanked.

Domestic (classic or not) muscle cars don't unless driven like a fool.

Why is that?
I've owned more cars then I care to count and when I drove any of my sport compacts and imports I get pulled over far more frequently then I do in any of my domestics. And when I get pulled over in either I get far more hassle in my sport cars then I do in my domestics.
I've experienced what I consider profiling and on far to many occasions to consider just bad luck.
A good amount of our laws and people that enforce them just paint with a big bloody brush and far to often officers are allowed to exercise judgment against us as they see fit when they can't even exercise sound judgment for themselves. This is the kind of activity that supports "profiling".

doubtful, but its a similar situation.

supman7 06-03-2010 06:13 PM

This is such awful timing now that they're really cracking down. My car is loud even with my silencer on, I barely drive it as it is and now the pressure of getting towed when I finally get to enjoy it this summer. Has the noise levels gotten that bad?

The next RS meet will be a all you can tow buffet, especially with the people who love to rip their car around will really bring the heat.

so if he denied that it was his car he could of avoided it entirely? Or would it gotten towed anyways? That's very excessive without even a warning, but I assume he was driving low revs in the residential area?

Very easy for them to put a note on your "profile" so next time your plate gets run you'll get one.

That's funny.

Friend of mine drove a highly modified 91 Integra (lowered, exhaust, rims, tint, stupidly fast). The only time he ever even got a speeding ticket in it was when he reved it out past a cop. Cop told him, if he hadn't been so loud as to catch the cop's attention, he wouldn't have even bothered or probably even noticed him. He got more tickets in a bone-stock '08 Civic than he ever did in his 'Teg.

Meantime, I got more speeding tickets in my wife's '96 Grand Caravan than I ever did in my GLC, 240Z, Subaru, and three Accords, COMBINED.

Maybe the real problem is that the people who complain the most about being profiled, ARE the ones who drive like fools and draw attention to themselves.

I think there will be a huge surge in enforcement for the summer, due to more moddified cars/bikes on the road and then this will slow/calm down. This law is not new,it was changed a while ago from a specific db rating/speed to the officers opinion.

http://www.bclaws.ca/EPLibraries/bcl...eside/26_58_04

This addition is not there?
“The opinion of an inspector as to whether the engine and exhaust noise is greater than that made by other vehicles in good condition of comparable size, horsepower, pistondisplacement or compression ratio shall determine whether exhaust gases are expelled with excessive noise.”

Death2Theft 06-04-2010 07:41 AM

It really comes down to annoyance level. I bet there will be tons of muscle cars that will get away with being loud vs 4 bangers and 13b's that sound like annoying weed whackers that get busted.

There lies the problem for me. too subjective.
