Tell her to look at the transfer form she signed. On the upper left corner there's a spot to check off if it's been rebuilt, altered, dismantled or salvaged and another if it's been flood damaged. There's also another spot to check off if it's had more than $2000 worth of damage. If it's been declared that it's rebuilt/had more than $2k damage and she signed the bottom, she's SOL.
Edit: I just looked and it's on the upper right corner of the form.

If you buy the vehicle from Canada, but it originates in the states it applys. I'm not sure though if you personally import it yourself, but I think they have a similar declaration law.

Just look at the transfer form ( Code APV9T at bottom left hand corner in tiny writing )
Top right hand corner, in the same box as the sellers info, there will also be boxes needed to be checked of by seller. 1)if ever used as a police, emergency police, taxi, lease, rented, etc 2) from out of province? 3) damage over 20% or damage over $2000
4) KMs
Go onto aircare and search up the old info, it will also tell u the past KMs on the car and if the guy potentially rolled back the KMs
also on the top right hand corner (first box) will have vehicle information,
ie reg,make,model,body style, colour, and the really important one in this case is
VEHICLE STATUS. If the seller put a "R" in that box.. ur argument is invalid.

Yes, she did a full inspection the day AFTER she bought it, and problem came up. Car was out of province and rebuilt. Guy is dodging the calls.
however we found out the car was purchased from icbc salvage yard early dec 2010, And we know which dealer purchased it. However she purchased it 2 days ago from a individual private seller instead. Which leads us to believe that these guys are partners. So that car was bought and "repaired" within less than a month.
I also called the so called dealership, and they denied they even had the car. Until i told him I had proof that they indeed purchased this car from the salvage yard did they cave in and admitted to having the car. They told me it was sold a while ago, however its only been within a month.
so were contacting the links that everyone provided and see how that goes from there.
I also dont want to publicize the name of the dealership just yet, until everything is settled. But just a hint, its in new west.

I don't see no case here.
If the transfer form says it's rebuilt but he orally didn't mention anything then legally he did actually mention it - on paper - that it's a rebuilt status.
If your friend bought it signing on A LEGAL DOCUMENT that does state the status of the car being a rebuilt then there is no case. The fact that she did not read through the details of the paperwork before signing on the dotted line does not make the contract unenforceable.
So the only way you'd have a case here is that the car is indeed a rebuilt status car but the copies with your friend and ICBC does NOT have the proper indication that the car was a rebuilt. In that case you can sue for misrepresentation.
Whether the seller is an accomplice with the dealer that bought the vehicle from the ICBC salvage yard is of no concern to this case - the fact is that the legal owner was the guy that sold the car and your friend agreed to the terms set out in the legal document that is the ICBC transfer form, which specifies if the car in question has a rebuilt status. The seller could have bought the car from the dealership knowing that it is a rebuilt status vehicle or, like the OP said, rebuilt it himself. It does NOT matter once a title is not a clean one it'll never be a clean one. Could be rebuilt the next year after the car rolled out of the factory for all that matters.

i have kept cars for a few days before selling them out.
at least your friend can do some basic research next time before they purchase her next vehicle.
