| Tenant destroyed the Washroom.
By destroyed, I mean they broke the tiles off of the Shower walls. The wall is missing like 6 tiles, and the wall is soaked through. There's water damage on the ceiling too.
I know it's gonna be pricey as hell to fix the damage, but I'm wondering if I can make them pay for it?
It's a single mother with a Gay(honger) son. He doesn't turn on the fan, and showers for at least 40 minutes 2-3 times a day. We've timed him, and it's been an ongoing problem.
Main problem is, my mom's too soft hearted to kick them out. They pay rent on time, and were okay with paying extra for the Water/Electricity bill. Plus, they're both single mothers and she feels bad for them. The Rental agreement has been up 3 years ago, and they're on a month-month basis.
I suggested on either making them pay for the damages, or to increase rent. They're paying $900 right now which is stupid cheap for the size of thier suite. The other tenant is paying $700 for his tiny bachelor suite. That's compared to our neighbours who are charging $1400+/$800 for thiers.
From what it looks like, it seems like we're gonna have to redo more than 50% of the washroom.
Ceiling, that wall, maybe the floor, and any other affected areas. I've already told my mom that I'll be helping her pay for all of the work.
So is there a LEGAL way to make them pay for it? Or do I at least have a LEGAL reason to increase the rent?
Also, anybody know how much this is gonna set me back?

You'll need to prove that the tenant was negligable and it wasn't a defect in construction I believe, which will be pretty difficult.
Tiles popping off isn't all that uncommon and it's usually caused by one of two things: an inadequate backer board allowing moisture to penetrate the grout and damage the wall board, anything from long fanless showers or the shower head being directed at the wall could contribute to this problem; the thinset used to adhere the tiles being improperly mixed or allowed to sit for to long before use resulting in poor adhesion.
How much it sets you back depends on many factors..
Is there mold behind the walls as a result of the moisture penetration?
More tiles are probably on the verge of popping off, do you intend on replacing all the tiles and wallboard just to be safe?

Tiles cant just pop off unless your tenant punched at it or used some sort of "tool" to pry it out.
Sounds like shady construction.

Yes they paid a damage deposit.
The damage was caused by her son who apparently fell in the tub and smashed the tile.
I'm guessing it's from all the moisture buildup since he never turns on the fan. I've never had moisture problems on my bathroom walls. The fans were newly replaced before they moved in, so there's no way that the fan was faulty and would've caused any problems.
I went back downstairs to see the damage, and there's mould buildup over the sealants. Along the sink/wall, the toilet/floor, and around the edges of the tub.
That kinda sent me over the edge with the fact that it's gonna be a bigger job, and I want to kick them out. But I convinced my mom to raise thier rent. Long overdue.

Wire the fan with the lights so they turn on at the same time, or install a humistat to control the fan.

Crisis Averted.
Broke the wall down, found Plastic lining. I just have to replace the tile wall itself, which is easy. Just gotta wait for my friend to bring his truck by so I can hit up rona.
Gonna repaint the walls too for good measure.

Mould buildup (black crap) over the sealant's is just from not cleaning.. If I don't clean my shower for 2 months, it starts to build up. Just needs to be maintained.

Use waterproof drywall or the tile backer to prevent the same thing repeating....

good luck with all the shit that's going on.
1) you can only increase rent to a certain limit. you can't increase unless it's justify and again there is a cap.
2) this is what we can call the cost of doing business. Either you go and fix shit up or you can file for taking ALL of their damage deposit say 450 dollars and hoping that will cover the cost.
3) his son hitting his head on the tile or if he was banging a chick and the tiles fell off... doesn't matter, re-read step 2.

The blue and green papered drywalls are water resistant, meaning they won't actively promote mold growth, but they'll absorb water and allow moisture to penetrate just as badly as standard board. It works well in high humidity environments like a bathroom or basement, but it's useless as a tile backer.
If your relatively inexperienced use denshield or the foam core tile backer made by schulter, they're light weight and easy to cut. If your experienced you could consider using durock, but solid concrete board is crazy overkill for anything less than steam showers. Use deck screws, not drywall screws, for any backer board.

So they've payed you about $40000 in rental revenue and cause you no grief other then some heavy wear an tear on the bathroom?
This upsets you and you think the grass is greener on the other side by the sounds of it. IMO fix the bathroom and be happy you have a tenant that pays up and thats not trashin the whole joint and install a fan that turns on automatically with the light in the bathroom and make sure it is vented properly to the exterior of the house.
As a landlord it is your responsibility to maintain the suite you rent out.

To seal the wall I used Redgard, then tiled over top of it - 2 coats will water proof your gympsum board. The tile board is OK but its super fragile and prone to chipping, and water damage funny enough. From my understanding it has also been discontinued, so supplys are dwindling. I recently redid my tub stall. It was a shit job in a basement suite - 4" tile directly over drywall. Once the lower caulking and grout started to fail, it just wicked up the drywall and it all had to come down.
I spent a few extra bucks and used 3x5' Aqua Tough tile backerboard, Kerdi membrane, Schluter tile edge, and 12" tile with a 4" glass/marble accent. 3 walls for the standard tub enclosure including proper screws, grout, mortar, silicone, paint for the rest of the bathroom, etc. ran me about $700 and I did all the work. The tiles/accent were actually pretty cheap ($250max). All the money went behind them to ensure no water issues down the road.
Yes I could've spent a couple hundred more on new fixtures but everything functions 100% so I just replaced all the O rings and cleaned everything up.

Anyways, a little off topic but, you are renting out your suite for $900, now you raised it? To how much, how many square feet is the suite and what area of the lower mainland are you in?
