The truck was definately pushing it and should of stopped, but it's going to be the ferrari guys fault. There wasn't much room between the truck and car travelling in front of him as they both went through the intersection, so the ferrari guy started to make the turn after the car passed without paying attention to the truck. I think you can actually hear the ferrari's horn before the accident. If the ferrari guy would of pressed the gas pedal instead of the horn he probably could of made it through.

Which part of town do you live in that people don't run red? Only a few months ago in Vancouver that I was almost hit by a car that ran a red. I wasn't even turning I was going straight when my light was green. And I top of that it was two, yes TWO that ran the red!

I hate to say this but it's always a truck to..., trying to prove something. Seems like everytime I come to a merge lane there is always a truck trying to either race up and sqeeze in or not let anyone else squeeze in ...,

Sorry, but in this case. It is always the Ferrari driver's / left turn driver's fault. The truck may get a ticket or warning for running yellow, but in the end, Ferrari loses big time.

Poor judgement by the Ferrari driver when turning.

It seems like that truck was trying to push it to beat the light but decided to change their mind last minute.

I absolutely hate that intersection.

Not necessarily - if the car turning left can prove that the other driver ran a red, it won't be the left turner's fault.

Exact same thing happened to a friend - got hit by car running the red. However, person behind him worked for ICBC, saw the whole thing, and testified on behalf of my friend. Oncoming car was ruled at fault.

What's to be updated on? It's gonna be the car turning left's fault. Even if the truck ran the red that would mean that the ferrari ASSumed the truck was going to stop.

Both drivers deserve blame in that case. The truck for running the red (assuming it can be proven) and the Ferrari driver for turning left in front of a large truck that was traveling full speed and clearly wasn't going to stop (as shown in the video). Left turners must be 100% certain oncoming traffic is clear before proceeding.

At the end of the day I think blame will be on the Ferarri driver. Insurance blame and traffic laws are not always the same. Even though one vehicle broke the law, it doesn't result in your automatic fault in the eyes of insurance companies.

Think about this scenario: Park in a no parking zone close to an intersection (illegal) and leave your car. If someone hits it, the insurance company will place fault of the collision is on the driver who it you (irregardless of the fact you were parked illegally). You might still get a ticket at the end of the day for the parking infraction, but not blame for the collision.

So the truck might get a ticket for running a yellow based on the video evidence, but the fault of the collision rests with the Ferrari.

If the ferrari is at fault I'm going to lose a lot of hope in the traffic system... Glad to hear he wasn't injured, although it is a sad sight to see that Ferrari in such pain. It could have been a lot worse if that ranger was a cubevan or a semi. Those things are the most prone to running reds for me, mostly because of their lengthy brake time.

Are you sure this is the case?

What if a driver is going wrong way on a one way street. And a car coming out of a driveway gets hit by this driver going wrong way on one way street.

It is the responsibilty of driver from driveway to ensure the main road is clear according to law. So whos fault is that?

Hmm... bad example. I think it's the driveway guy's fault because he's entering a "highway".

Then again, I am not ICBC nor do I interpret traffic law on a regular basis!

Fault is on the ferrari, I hate it but that is how I think icbc will rule.

When making a left turn you shouldn't feel rushed or scared you actually have ultimate control of the intersection as on coming traffic are not permitted to enter a intersection untill opposing traffic has cleared it.

If your in the intersection waiting to make your left turn and are forced to wait for the yellow and still are not comfortable keep waiting if the light turns red you can still wait until you feel it is safe to proceed with the turn. Even if you force all 4 directions of traffic to stop for few seconds it is always better to be safe then sorry. Honk at me all you want my legacy is buckled into the back seat lol.

If you are making a left hand turn in an intersection, oncoming traffic MAY NOT proceed if they cannot clear the intersection because you are in the way.

As I mentioned before, I was in this exact situation and ICBC ruled 100% my fault. I went to arbitration, AND WITHOUT ANY EVIDENCE, I was able to convince them that it wasn't my fault.

It can be done. Fight it. Asshole who blast through stale yellows or reds when the intersection is busy should be the ones paying higher premiums.

First off, the people who run yellows may be going too fast to stop.
The only assholes are the ones running the red.

In every case, yes EVERY SINGLE CASE, the person making the left can control whether there is an accident or not.
It is the poor judgement of the car turning left which causes accidents.

So good for you that you won your case, but please don't tell everyone turning left here that they are good to turn
when the light is stale yellow or red, assuming they can fight it after they get hit!

My advice: Don't turn until it's safe...green, yellow, or red.
