That's why he specifically said STALE yellows.

If you run a stale yellow, then you're going WAY too fast and/or have reactions so slow you shouldn't be driving, and/or are distracted.

The only assholes are the ones running the red.
First off, that's not true at all, they can be the ones running late yellows also. You *might* be going to fast to stop, but I bet a lot of people are speeding up to make the light.

It is the poor judgement of the car turning left which causes accidents.

So good for you that you won your case, but please don't tell everyone turning left here that they are good to turn
when the light is stale yellow or red, assuming they can fight it after they get hit!
Obviously he's not telling people to purposely take a chance at getting t-boned and killed. No one thinks that. Yes, it can be prevented by the left-turner, but that certainly doesn't make the person going straight innocent. He's saying, if you're getting screwed over by someone who sped up or ran a red, you CAN fight it, don't just give in to ICBC.

Please don't assume that people are doing that. If you run a late yellow, I'm sure you wouldn't want people to assume you are purposely speeding up to make the light.

not a ferrari but i believe there was another accident today on boundary and 1st ave, i work at autohaus and there were firetrucks, ambulance, police at the intersection..and i bet its because someone was turning and the other person was tryin to beat the yellow light. I always see things like that in that intersection..its scary how many times i see it

^ that's an incredibly long delay, normally it's like 2-3 seconds

Should have timed it from when the light goes red and the other light goes green.

I know "the guy turning left is always at fault" is a common belief, but there is a grey area alot of people dont know about. a friend of mine was in an identical situation as this but he was the truck not the Ferrari.

in some situations, if two vehicles enter a yellow light, regardless of whether one is turning left or not, the one who enters the yellow first has the right of way. so if the ferrari was sitting in the yellow waiting for his turn, and the truck entered the yellow while the farrari was there, the truck could be at fault.

my friend was fount 100% at fault when he hit a guy turning left. they were both running yellows, my buddy was going straight, the other guy was running a yellow turning left, but my buddy ran the yellow after the other guy.

me too, i drive by there 2-3 times a day on weekdays, that truck definitely ran a red, i've almost been hit there too; it's the worst when a car almost stops completely then at the last second decides they're gonna run it.

Hate it when u're at a tough position and u get hit by some idiot...then ICBC tells u oh that's TOO BAD so sad u're at fault kinda thing. Who knows if they're saying the same thing to the other party too!?

if that's the case 90%+ of the time left turners would not be at fault as they were already sitting in the intersection the whole time waiting for the light to to turn yellow/red.

If you're doing 75kph in a 50kph zone and you can't stop for a yellow, guess what: you're an asshole too.

First of all: No, not in "every single case" is it completely in the control of the left turner.

Remember, you may not enter an intersection if it is unclear. The same way a left hand turner may not start a turn without ensuring the way is clear, straight through traffic must not enter intersections without ensuring the way is clear too. Just because you have a green light, doesn't mean you can run into anything that is in your way.

In my situation, I won because there was no way anyone could have known the guy was going to run the red. He actually got on the brakes, you could see the nose of the van drop down, and he had almost completely come to a stop before the light, then he suddenly changed his mind and ran the red.

I raised my case because I'm sure there are other people who are victims of red light runners on a left turn. They should not be found 100% responsible when the other person has run a red light.

Quote:
My advice: Don't turn until it's safe...green, yellow, or red.
Good advice, except you may THINK it's safe, and still get hit by someone who's not paying attention. Better advice is to drive like as if NOBODY around you is paying attention. Assume that everyone is an idiot and is trying to drive into you.

that wouldn't be good enough, we wanted to see if he had enough warning to stop in time. the change over from red on boundary to green on moscrop was less than a second i believe.

Update:

The truck was found 100% at fault. The Ferrari driver called me today to share the good news. He told me that Testarossa is very rare because it was the first year of production on that model and it was not for sale in Canada(or north america, not sure). There are only about 50 of them left in the world..he hopes to replace it with the exact same year and model as this car was very special to him. We are meeting up this weekend, he said he has a gift for me..I told him to forget the gift and just take me for a ride when he gets his new ferrari , but he insists on giving me something, sooo..if a rich Ferrari owner wants to give me a gift, who am I to refuse hehe
