I would have liked to see the 15 seconds before the video began to fully evaluate the situation as well.

i was holding my breath at the end of the video as it looked like you were about to rear- end him again.

yah definitely let ICBC deal with the legal mumbo jumbo. Settlline privately makes you very naked and vulnerable.

We are actually talking about paying off the claim to avoid the increase in the annual insurance amount and the moving up on the CRS levels.

False. They "ding" the rates of whoever owns or is the primary operator of the vehicle.

Also if the owner has a rather clean history with a high discount rate (about 40%), the insurance rate will take a small hit.

Assuming the the owner of the vehicle gave permission to someone else to operate it, they will take the hit at the end basically..

From my own experience when I was at fault:

I rolled too far past a stop sign and got hit by a Mazda 3. His passenger front hit my drive front. I first asked him if we could settle it privately so my premiums don't go up and he agreed. At this point I haven't told my mom yet because I was shitting bricks lol.

Couple days later he calls me and tells me that his damage was $3300 or something. I then tell my mom cuz it's quite the sum. My mom said "tell him to stfu and call ICBC". Because ICBC will actually go to his ICBC approved shop to estimate the damages to ensure that he's not trying to scam you.

ICBC later mails me a letter saying that the damage was $2600. I would've been scammed out a good $700.

Lesson learned for me, don't settle privately! Going through ICBC doesn't mean premiums going up. I still kept my discount at the end.

^Did the private thing once too... they called saying the shop told them it would be $300. I told them to call me when it was done and I'd come down and pay the shop. Later they called and said the work was done and it was $600, but they were leaving the shop and I could just give them the cash.

So I told them I wasn't paying and they should go to ICBC.

I didn't. Never heard from them. Don't recall my premiums changing, either. Suspect the "victim" never went to a shop and was just trying to scam some cash from me. My plate made a little gouge in her plastic bumper - cosmetic only. I doubt they ever bothered getting it looked at.

EDIT: I talked to ICBC and i have a appointment on monday for them to see the car and give me options, im most likely going to just pay the price and get his bumper painted. Does anyone know if the whole bumper has to be replaced because of a 30cm long deep gash?

Thats basically what happend to the 5 series aswell....my plate gave his bumper a gash.

If the 5 needs repairs, let ICBC deal with the repairs... then you just repay ICBC. All these stories are showing what can happen if you try to deal with the other car owner directly. ICBC won't let drivers or shops scam them into doing more work than is needed, or paying more for it than it's worth.

Same thing happened with me - was driving dads van and rear ended some kid. Paid off the repairs since it was pretty cheap and dads insurance premium didn't go up. Didn't bother getting the van fixed since it wasn't that noticeable other than a hole in the license plate lol

hmm did a private once instead of icbc. total waas around 900 after backing into a 2000 civic custom lip and was cracked in half. Sucks that i do not know whether i got scammed or not but i didn't want to tell a certain family member

Can you see through where the gash is? Or is it still intact? If its literally a hole, they will have to replace the bumper.

Dude, if it past the clearcoat/paint, it's near impossible to cover from that.

clearly if you slid and hit him.. it wasn't 'plenty' of room. if it was plenty of room you wouldn't have hit him. that's what plenty of room means.

anyways learn from your mistakes and don't follow so close, especially in the rain, and especially when you're driving a car with no abs/shitty tires. i learned that the hard way too except i got lucky and rear ended some big ass pickup truck a few years ago. good thing he had some beast chrome rear bumper and my car didn't leave a scratch on it, except my hood was fucked up. he came out, took one look, laughed at my car, said it's fine and drove off.

also if he claims for whiplash it's really not bullshit, i got rear ended once before as well at somewhat similar speeds to you and i felt neck pains a week after but didn't claim anything. your neck muscles really are sensitive to sudden jolts like that and just cause he doesn't come out holding his neck doesn't mean he won't develop neck pains a few weeks after.
