Now that ICBC has agreed that there was damage done, hopefully the police can charge GFAinRV for the crime. I have emailed the two constables assigned to my case and given them an update on the claim and CC'd my adjuster in the email.
Only when and if he's charged for the crime will I be compensated for my $300 deductible. Will keep you guys updated as always, regarding being compensated.
Adjuster asked where I got the dashcam and AGAIN I provided asr's info. I should start demanding a cut of the profits...
Very glad and relieved that the adjustor didn't try to bs me into believing there's no damage. | |

Unfortunately, they can't go after him on his policy since it isn't a collision claim involving his vehicle.

oh yah and i hope that piece of shit gets whats coming to him. Nothing than i hate more than assholes that have no respect for ppls property. including the idiots that ding doors and don't care. In a perfect world that guy should have that hot coffee poured all over his face and all his arms and legs broken.....but maybe thats just me.

You should also be able to sue him in small claims court for your deductible if he isn't charged with vandalism.

The police constables got back to me today via email. In short, they will not be pressing charges because "they can't prove that the COFFEE caused the damage" (who says it's coffee? Fatass did? That's nice.) He also mentioned that "all he has to do is say he didn't intend to splash my car with the coffee"... wtf?
However he mentioned there's some hope yet! He says we can try and see if he'll agree to pay for the damages voluntarily! Wow, that's great!
Unless there's a collision or if you catch the perpetrator taking a baseball bat to your car, you can forget about pressing charges / getting your deductible back.

Isn't only the part where the coffee splashed on had the clear coat damaged? Wouldn't this be pretty conclusive evidence in that the coffee damaged the paint? He may not need to be criminally charged, but he still damaged your property. Wtf is this BS.
So technically if I Accidently puke on someone's car, it's okay? They cannot "prove" my puke damaged the car, nor did I do it on "purpose". At least the property owner deserves compensation. Posted via RS Mobile |

Not sure I understand the logic, video is right there, ICBC agrees it damaged the clear coat.
Sounds to me like you’re getting the bush off from a group that just doesn’t want to deal with something this small. It’s a shame too, because people like this need to be shown that they can’t get away with doing whatever they like. I guess here, they can, even if they are caught on video.
