it will depend on the market value of your car - current kms / options / etc.

Do some Craigslisting to get an idea of what it would cost to replace the car, then when you get your estimate, you know how close / far away you are from a total loss decision.

No. ICBC is a business and driving is a risk you assume. They cover only the value of the car you drive if you pay for the appropriate coverage and or injuries if applicable. Meaning if the car is worth 5k they will only cover to a maximum of 5k be it in compensation for a total loss or repair. You can refuse a write off providing damages dont exceed the value of the car but thats it. The other option is buy back (with a salvage title) providing the damage isnt to extreme just exceeding the value of the car. I'm currently building up a YJ for a client who went this route. ICBC valued the damage exceeding the value of the Jeep but the client had sentimental attachment to the car so ICBC allowed him to purchase it back from them with a salvage title. Once repaired and once it passes two different type of inspections it can be re registered as a salvaged vehicle.

Thanks for the response fellas...The guy still has not claimed responsibility. It was a company truck with the company name and number all over it which is how I got the companies number, a witness wrote it down. But ICBC is telling me that without him personally claiming responsibility they have no way of knowing who was driving the vehicle, so this sucks because I will have to pay $750 deductible.

I reported it to police and ICBC ASAP so they have both called the owner of the company to urge the driver to come in to ICBC as well I have retained a personal injury lawyer and he has called the owner of the company for the same reason and still nothing.

The owner is being outright uncooperative, he refuses to tell where he parks his trucks and he refuses to provide the licence plate number of the truck and refuses to say who was driving the truck. The truck that hit me had a power tailgate on the rear and the company only owns one with a tailgate so if I at least knew where it was parked I could get a plate and take pics of any paint from my car left on.

Is that possible? BMW parts are expensive, and if you look at the parts I listed in the OP that are damaged I think it will at least be 4k or more.

Also can I bring it to any body shop providing its ICBC accredited? Including a BMW specialist or dealership?

Thanks man I hope so too...One of the witnesses I spoke with said that he had his headphones on at the time and they were on really loud and he could hear the collision over the music so in his own words he said there is no way the driver didn't notice. Plus I was honking like a mad man while he was speeding off.

I do have receipts for most mods although I install them all myself for the most part so re-couping labor ... what happens there?

The market value of my car (without the mods, rims, stereo etc..) seems to be between 4k-9k according to my searches.

I will post up some better pics soon, thanks for the responses!

unfortunately the labour doesn't add anything to the value. And yes, though OWM BMW parts are more money, ICBC will estimate the value using recycled and aftermarket parts where available. And yes, it's your car - you can choose to get it repaired at your preferred shop (including a BMW certified one)

You'd be surprised. Some trucks are so loud inside that the drivers actually wear earplugs to prevent premature deafness. Some drivers are also just that unaware of what's going on around their vehicle. I have a gigantic bright yellow concrete pole sitting in front of the corner of my building which acts as a barrier from trucks hitting it. I can't even count on two hands the amount of drivers who have rammed into that pole... it's not like it's hard to miss. I even had one driver hit it... pull forward a foot, gun it, and try ot run it over again. I didn't even bother trying to stop him. He fucked with his power lift gate baaaad. Served him right for not getting out of his truck and finding out why his truck was magically being stopped at a certain point.

Another question, the driver of the vehicle who hit and ran me has not come forward. The two witnesses and I all saw the company name on the truck and the phone number for the company (all over the truck in big red letters) and the owner will not tell me or my lawyer who the driver was nor will he provide the plate number for the truck....so this is a massive inconvenience for me because ICBC said that without someone coming in and claiming responsibility I have to pay a $750 deductible...even though I have witnesses!

Any recommendations? My lawyer is not interested in the car damage claim, only the injury claim so he is of no help.

Like can't the police force the freaking owner of the company to provide them with who was driving that truck that day? It seems ridiculous, I thought hit and runs are supposed to be criminal?

Public shaming. Post the story on Facebook, here, etc. When people start Googling the business for information, they'll hopefully see your story.

I've tried that. I have called the company, which runs out of a house (834 East 10th avenue Vancouver) and the owner refused to tell me where they park their trucks, refused to tell me who was driving the truck and refused to tell me the plate number of the truck.

I did find where they park a couple of days ago and have been there a couple of times now and he has not parked that specific truck there since the accident.

He has about a half dozen trucks and it is the only one with a power lift-gate on the back. He confirmed this when I called posing as a potential customer as well as one of his employees whom I spoke with also confirming they only have one truck with a power tailgate.

ICBC doesn't seem to be of any help nor does the police, both say that unless the driver himself claims responsibility or at the very least reports he was in an accident there is nothing they can do because there is no way of proving who was driving that truck.

What bugs me is that the owner would have it documented and refuses to say.

I wouldn't be surprised if he was the driver. Small companies run out of their homes are shady news. If it wasn't him it was probably his cousin, brother, close friend, etc.

At this point, I think you are out of luck. He's denying anything, and if I was that guy, my truck would already be repaired (not saying that I'd run, but if I was shady to act like he is).

Follow through with any injury claims, and bring his business down.

it could an owner operator truck so the insurance wouldn't be claimed through AJK. The truck may have AJK decals on it but that truck would just be doing contract work for them.

hopefully everything works out for you in the end though.

Depends on what E36s are going for nowadays. I don't see 3k in repairs there, though.

I think in ICBC's eyes the damage on your car does not look severe enough for you to win the injury lottery.... but who knows maybe you got severe whiplash or going through emotional distress and loss of enjoyment

A single OEM headlight for e36 is $350...and my 328is fully loaded with m-sport package and lots of mods is worth well over 3k

ICBC writes off @ 70% of value (could be 80%, I've been out of BC for a bit). Your car is probably worth around 3-4k stock, and I've heard from other BMW owners that ICBC doesn't give a rat's ass about mods and stuff. They care that it's a 328is.

But like I said, it doesn't look like a write-off.
