I could see lots of scenarios (as extreme as some may be) where lawsuits will come into play if phones are seized. Everything from business people claiming all the business they lost due to customers/clients unable to contact to schools calling emergency contact and no response. Just a few examples off the top of my head.

Fine for me. But i guess they might need to think about those that use their cell phones to conduct business...It would suck for someone to lose out on a 25K deal just because their cell was seized.

I can't belive the amount of people here that think its' OK for the govnt. to TAKE your phone away for 24hours? Without sounding like a broken record and a bit cliche, this is not Germany in the 40's. We live in a free country. Sure it's against the law to use a phone while driving. So maybe do a bit more enforcement and make the fine higher. Every police officer I know (and I know quite a few) say the traffic enforcement has dropped to the floor in the last few years due to under staffing and way more important things to attend to like domestics, robbery etc. I remember I used to see 5-10 cop cars a day on the roads. Now I see maybe 2 if I'm luck.
LA has had a no phone rule for a while and nearly everyone follows it there, why? Because there is actual enforcement and larger fines. Heck, I remember having a cop car pull next to me one day and the car infront of him was on his phone and he didn't even notice (or didn't care because he had more important things to do?)

This is starting to get out of hand. First with the road side impoundment and suspension that used to require a review, now cops want the ability to seize cellphones? Whats next?
There used to be a legal process for this kind of thing and alot of the powers police now have at roadside are things that probably needed a criminal code conviction in the past. the power given in the MVA seems to be far surpassing the criminal code. Cops should not be given that authority simply based on their opinion without PROOF shown in front of a judge. It is all their word against yours which is pointless anyway because by the time you have a chance to fight it, its already over. It is you, standing there at that moment, with ZERO power against another person given all of the authority.
It was one thing with the increase in fines, I can buy that, as its fairly obvious fines are being used as a massive revenue stream. But seizures don't benefit the police or the province, they simply just fuck people over.
What if a cop came to your door with no warrant and seized your computer on the spot for suspected computer piracy because his UNPROVEN opinion is that you may have downloaded something. Not because an overseeing authority gave the go ahead, simply because he felt like being a dick that day.
I have nothing against cops individually. I haven't ever had a bad experience with one, and I know a few amazing people who are cops. But the law is giving them as a whole too much power.

It's the 21st century where having a phone is a piece of mind.
also, a phone is just as important as having my license in case my car ever breaks down/get into accident...not to mention how handy the camera on your phone becomes to take photos of the accident.
