no they can be charged with conspiracy charges, terrorist activity charges, charges for having bombs (possessing property for use of terrorist purposes, etc) hell they could have charged them with terrorist charges just for buying the material to make the bomb (yes for buying nails, pressure cookers) etc etc
they really didn't need to allow them to place the devices and it was a very stupid risk imo regardless of how confident they were in the devices being inert
if the devices actually went off i bet that would have been left out
