*help* Got Reversed into by a pickup @ a stop sign
 
Hey guys,

I'm looking for some help here.

Last Thursday, I was behind a Ford F150 @ a stop sign on 62nd & Knight St when he decided to reverse. He hit me and claimed that I am at fault.

I don't have a dash camera and no witnesses at the scene. Being the rear car, I have the most to lose even though he backed into me.

I've been combing the area for surveillance camera's but came up empty.

Have anyone experience this before and any tips on how I can over rule this? I know it's an uphill battle. But any feedback would be appreciated.

That doesn't look THAT bad acutally...

I had that happen to me.... and the whole front end was crushed..
Light tap too...

Maybe post some stuff around the intersection?

same thing happened to me years ago. Lucky the guy that backed into me admitted it. To be honest, unless you find a witness or he admits it ... your out of luck. When I reported it to ICBC, they even told me that if the guy doesnt admit it, I'm gonna be a fault. Tough luck, not much you can do.

I had it happen to me once - and I had the guy there sign something admitting his fault. But if he had refused to do so, I probably would've been in the same boat as the OP.

On dashcam.. even people who have dashcams.. this might be a good reminder to get the card out and check if it is recording correctly (I suggest you at least do that once a month).

Was he stopped at the stop sign? Or did he already roll past the stop sign and the white line?

Legally, you are not allowed to reverse once you pass the stop sign/white line.

Same thing happened to me. First night I got my new car, these guys in a TL pulled into an alley and then stopped, I stopped, waiting for them to keep going forward so I could keep driving down the road (I wasn't turning into the alley). They put the car in reverse and started rolling backwards, I LAID on the horn, they stopped for a second, then kept going and hit me. It was in the middle of downtown on a Friday night and by the time it happened I couldn't find a single witness, they of course lied and said I rear ended them, and bingo, I ended up paying to repair by brand new car. I hope they, and the guy who backed into you, get absolutely raped by karma.

He was well over the line trying to make a right turn onto Knight St. He inched up and decided to reverse back. I actually had a good 4-5 feet between us. He didn't roll back, he gassed back.

Thanks guys, I know it's an uphill battle.

Going into ICBC Tuesday, maybe from the damage/marks they can determine something.

but no seriously good luck, odds are stacked up against you. I could preach about getting a dash cam but it won't help this current situation, hope he has a history with Icbc that would help them sway in your favour

Only thing that might save you here.. if you get a good adjuster... sometimes they can measure the high differential between the two vehicles and see that you weren't "diving" in the front, that he was actually reversing into you. I have never experienced this myself.. but I have heard of it happening.

Yeah, I was talking to an agent over the phone. There has been a case where a truck (Garbage truck) to be exact, reversed onto a car. Due to the height difference/damage they were able to find who was at fault.

I'm hoping since my car is significantly lower and his higher can reveal something.
I was also not directly behind him as well, so he hit me at an angle. We were staggered.

just have one of your friends say they were in the car with you when it happened....BOOM there is your witness!

theres got to be a way to determine which direction the vehicle was travelling by looking at the damage.

wait if someone fakes being a witness, and the truck driver claims the witness is fake, who does icbc believe.

If he passes the line, he is legally required to proceed or stay put. It is illegal to back up and away from the intersection.
