| hit and run, neighbor knows driver, wont give info
So my new truck was backed into the other night. My neighbors across the street witness it all and said the passenger jumped out of the car after the incident and went into my other neighbors basement suite, the driver took off.
I went over there and they acknowledged this guys girlfriend hit my car and she probably didn't even realize, yeah right. They told me they would let her know and she would be contacting me shortly. Its been 2 days and she has yet to call me. I text the tenant, the drivers friend, to let him know she has yet to contact me and he isnt returning my text.
So I opened up a icbc claim and awaiting them to get back to me.
Where do I stand now and what is icbc going to do to get this drivers information. I have a witness and the drivers info is there, its just their friend is unwilling to give up her info. I am not worried about my car being fixed. I pay the deductible and icbc fixes it but it just pisses me off this person might get off the hook.
Anything I can do. Should I call the cops to file a report? I am sure if an rcmp officer went over to this tenants door he will give up the drivers info. Is this something icbc may do.
any insight is much appreciated,

You have reported it to ICBC and you can also report it to the Police as it is a hit & run. Give them all the info you have and the info you have about the suspect, in particular.

If ICBC hasn't acquired the driver's information from the tenant yet. What you can do is try to get the car's license plate. Keep an eye out for this car so you can report it to ICBC and then get a matchup done.

^ my car was parked and hit recently, just a scrape on the bumper.. person that hit me left a note "sorry i hit you car, didnt notice any damage.. sorry again"

Consent to record need only be provided by one party participating in the conversation. (Section 184 of the Criminal Code)
Admissibility in court would likely be a hurdle though. I'd anticipate certain criteria being applied to ensure its authenticity, completeness (viz. not taken out of context), and proof enough to positively identify the voices on the recording.

I am surprised ICBC didn't tell you to report it to the Police as they do for all Hit and Run cases (as far as I know), which can be annoying because a lot of hit and run cases aren't hit and run. Anyways, if you have the plate and a statement from the witness, you are good.

On the ICBC website is says in the event of vandalism or a hit and run the steps are to call your local police and file a report before calling them.

speaking on behalf of the surrey rcmp we would take a file for that MVIHR. but the neighbor doesnt have to give info on vehicle technically and as they are also the witness would be a difficult file... but worth it to report anyways

I'm sure the file investigation would include interviewing the witness to see if the suspect driver of the car could be identified. Where a suspect had been identified I always followed up with an interview to gain all the facts. How can you conclude a file without doing that? The boyfriend might be reminded that he may be considered an accessory after the fact if he knowingly obstructs you by not identifying her at least.
I'm sure the victim might be able to identify her even if the boyfriend witheld her identity. He sees her car & gets you the BCL. Run a 28, talk to the RO and ask them to identify who was driving the car at the suspected time of the H&R. As you know, the RO is required to do
Also ask to see the car for any possible damage. This is not trying to find the Ark of The Covenant, it's a simple H&R. Why should the victim pay for the decuctable if the suspect is responsible for the deductable and the damage?
