because the cars are 'setup' for the other 2 drivers
Yeah, what a joke! they already have Giedo's seat mold from last years reserve role as well. Sauber F1 has been a joke ever since Monisha Kaltenborn took over for Peter Sauber.
Also Sutil is suing Sauber F1 as well It's funny to think what will happen if Giedo wins cause one of Nasr and Ericsson might have to make room for Giedo and whichever doesn't have a spot is gonna sue Sauber F1
They're fucked either way. Nasr is bringing in 60m from Banco De Brasil and they're having second thoughts about sponsoring Sauber F1.

What makes it more ridiculous is you would think Sauber should have known this was coming! They must have a team of lawyers on their payroll not to mention Monisha, herself, is a lawyer!
Guess we'll see if Australia will holdup the Swiss ruling tomorrow afternoon (they should...)

the appeal was dismissed!
Quote:
The Sauber Formula 1 team's appeal against a court verdict that Giedo van der Garde should race for it in the Australian Grand Prix has been dismissed.
Former Sauber reserve van der Garde launched legal proceedings against Sauber after he claimed that the team went back on a race deal that had been agreed for 2015.
This claim was upheld in the Australian courts on Wednesday, but Sauber immediately appealed the verdict.
However, following the appeal, the Supreme Court of Victoria dismissed Sauber's case, backing up the previous verdict.
A statement read out in court on Thursday said: "We did not consider this course [the appeal] to be in the interest of justice.
"The appeal is dismissed because we see no error in the reasons of the trial judge."
Part of Sauber's case was based around the safety risks of a using driver unfamiliar with its 2015 car. This was also rejected by the court.
"As the judge observed, these events are highly-regulated and we are sure that all safety requirements will be complied with," the statement added.
The decision means that Sauber effectively has three drivers - van der Garde, plus its 2015 line-up of Marcus Ericsson and Felipe Nasr - for only two cars this weekend.
The court dismissed Sauber's appeal on Thursday and ordered the team to pay his legal costs,
Formula One racing director Charlie Whiting told reporters that Van der Garde could not race without a super-license but a day before Friday practice, would not rule out his ability to get one.
"All I'm saying is that there are procedures that are dealt with through the team, through the ASN (national sporting authority) of the driver concerned and the FIA in Geneva," Whiting said.
"The safety department in Geneva deal with that."

well the judge adjourned the enforcement to Sat morning and said that both parties should negotiate a settlement by then else Monisha is going to see a prison cell
Rosberg was saying how he wanted to get rivals to get closer for more entertainment then Seb was saying something about them having an open garage for Malaysia and Nico invited him over

NR: I hope we can have a good fight. That would be awesome. I think the next couple of races we’re going to be leading the way for sure, and we’re going to try and keep it that way, but we know it would be good if they can come a bit closer, as long as they don’t come too close…
SV: Be honest. Do you really hope so? Seriously? You finished 30 seconds ahead of us and you hope it’s going to be closer? So you hope you slow down? Is that what you’re saying?
NR: I hope that you can give us a challenge! Because it’s important for the sport and for the fans. And I do think about the show. Half of me – or a part of me – thinks about the show because I want to give people a great time at home watching on TV or at the track. If you do come a bit closer, that would be awesome for everybody.
SV: First suggestion, if you don’t mind, I think your garage becomes public for Malaysia and everyone can have a look. No? I’m joking.
NR: You can come if you want, we can invite you…
SV: OK, thank you for the invite, I’ll come.
NR: Friday Malaysia, OK.
SV: Engineers’ room? Debrief, I’ll be there.
