Now that the insured has claimed injuries you cannot pay back ICBC for the vehicle damage and not loose your discount. You will eventually be sued by the other party if he wants to keep escalating the injury claim.

Doesn't matter, icbc won't let you pay out a claim if someone claims injury. Injury claim can persist for years even if it's bogus. I got screwed over on a tiny little fender bender like this myself.

Problem is that everybody always claims an injury no matter what now days

Wow that sucks.

Cause ICBC will shut down his injury claim in like 2 seconds flat with that video, and the damage to the vehicle.

If the guy chooses to escalate it, he would really only be wasting his and his lawyers time. Don't even know why a lawyer would take such an obviously bogus case, I mean I understand how injury claim lawyers work, but this case isn't even going to be worth the paper it will end up printed on.

On another note, I hope this guy gets into a real car accident one day, so he can understand the pain of real injuries. Beta ass bitch.

update.
the reason why the driver is claiming injuries is because he said he was involved in another accident 3 months ago. And no, he doesn't know I have a dashcam.
I've been reading and researching a lot on low speed accidents and it seems like icbc will most likely dismiss the health claims under the "low velocity program," however if he goes to court, which i guess why he has a lawyer, then the judge will usually grant the plaintiff about 20-30 thousand dollars since low speed impacts doesn't equate to no injuries.

Yeah... there is no way for you to fight for that accident to be in your favor. A rear-end is almost always your fault, unless the other driver cut you off and you can prove that he did not leave you enough room to slow down or stop.

My recommendation is to pay off the vehicle claim damages. If you let your insurance pay for it, you will pay it off 2 to 3 times that amount over the years.

Sucks OP,

As everyone has said you will be totally at fault, pay the for his bumper if the damage is minor enough to make it worthwhile.

100% submit the video as fraud for an injury claim, MF's like this are the reason insurance rates go up for all of us. As Im sure, all of us who pay ICBC for insurance are thankful for you having a dashcam.

everyone keeps saying to pay it out. but again you cannot pay out a claim when theres an injury. even if its just a minor tap on the bumper, you cant pay it.

for those who think its stupid i agree, we have a shitty system in BC. we should have a no-fault system which significantly reduces fraudulent claims. Right now hardly anyone claims an injury if theyre at fault, but if anyone isnt at fault for even the most minor tap they claim everything under the sun, we are all paying for this fraud
