What is the standard for icbc to consider a car totalled? Not my car but, damages came out to ~9k. Car is g35x 2008. Seems to be worth 12~20k on craigslist. Can you do anything to recoup the devaluation an accident like this would cause on the car? Car was stopped when it got hit. |
You cannot recoup devaluation. |
they have a repair ceiling (dollar value) for each car, if the repair bill comes out higher, it will be a total lost |
You can always take total cost of repairs + salvage. Depending on the accident and condition you could get anywhere from $500 to 5k |
You can recoup for depreciation, but you will have to sue icbc in small claims. One way to do so will be to sell your car shortly after and prove that you got less than market value. Makes no difference that it was stopped when hit. |
its called an accelerated depreciation claim, and it's pretty rare that icbc will reimburse you except in extreme cases. like ^ said, only way to do it is through the courts, and if you take it to small claims they'll likely hire a lawyer to fight you. its unfortunate when you're not at fault, but you pretty much just have to suck it up and move on if it isn't a clearcut write off though, you can continue disputing it with your adjuster, and they can find ways to up the value on your car to make it repairable. if its a total loss 3 times over though, then there's no chance of that either. biggest question is do you want to take your chances with trying to sell a car with a 9k hit on it later on, or do you want to just take the cheque now and move on? |
