MVA does not work that way. Try again.

probably wasn't able to logically respond to all the people who commented

Swonz 10-21-2019 06:03 PM

btw I saw Cain VI a yellow Scion XB on Clark and Broadway. The car wasn't even low, it was just yellow. Also that Mercedes C-class VI was bs

you! 10-22-2019 03:57 PM

The guy is just being a straight up fuking prick. You guys have to keep in mind that this is the same asshole who's stripping plates and towing cars that are oem spec or close to it for box 1 because of minor things like exhaust and window tint mods, while at the same time giving only a box 2 for that doczilla #whatsnext LB gtr that is 999x more modded and non compliant with mva

How the fuck does that even make sense? Just one of the many examples why I think this guy is unfit to be in any profession with authority just because he practices the law all based on his own opinion

How it's even legal to have a car towed and impounded for having a loud exhaust is beyond my comprehension.

I believe when Doc got his Box2 the FRS behind him got a Box1 for exhaust.

Berz out.

AzNightmare 10-23-2019 02:23 AM

lol... Wasn't Doczilla supposed to have some kind of meeting with Cain? Did that ever pan out?

I recall when his heavily modded GTR got VI'ed, he just drove his heavily modded NSX the next day.

On the flip side, how is this different than an officer writing you 10 over the speed limit when you're doing 40 over? No one freaks out over that. If a law is broken, they can enforce it and apply the legal maximum punishment. However, police do have "Police discretion" based on your history/record/offences/likelihood of re-offence etc.

Not everything is 100% black and white and cops do have some leeway to enforce or not.

Yes, we need heavily modified bait cars (seniors driving) and see if the theory above works. :lol

Prime example of how not everything you see online is the whole truth.
1st- Doczilla doesn't own that car anymore
2nd- It wasn't him(doczilla) that got the VI
The new owner messaged doczilla and he(doczilla) posted it on his page.

Of course it works. I've been pulled over four times, never once got a ticket.

BABU 10-24-2019 04:36 PM

Officer Cain closed his Instagram account ?

Uh did you not read the entire insta post where Doc out right said he was the one pulled over and had a long talk with Cain personally?

Berz out.

Where did you get that info? As I recall, it was doc himself that was pulled over and wanted to set up a meet up with Cain.

Akinari 10-25-2019 08:55 AM

Let's not forget how much of a hypocrite Cain is by turning a blind-eye to heavily-modified exotics owned by high-profile local "celebrities" like Kevin Gordon and JJ, going as far as to give Kevin a police escort to Spanish Banks for a charity event and sharing it on his Instagram, while other commoners doing similar charity drives in STOCK exotics are getting pulled over for their STOCK exhaust systems.

If this isn't the most cynical trash ever, I don't know what is.

I just can't comprehend how someone who so furiously defends himself as being a true car enthusiast with a passion for cars, can so shamelessly turn the entire local car enthusiast community against him, and seemingly be totally fine with it, while continuing to spread fake news about cars having -8 degrees of camber.

He's like the Trump of the VPD Traffic Division.

trollface 10-25-2019 09:39 AM

You just learned laws are not applied equally to all? Sweet summer child.

68style 10-25-2019 09:56 AM

Agree with most of what you said Akinari, though the commoners with exotics part did make me chuckle

I'm in a lot of contact with police(Burnaby RCMP) at my current job. They usually end up staying and talking for 20-30 minutes depending on the day. I've talked to them about this whole VI thing, asking if they're having some sort of crackdown themselves. All of them (3) said no. I mentioned the whole thing with VPD and how they're making people go to specific dealerships. All of them said it shouldn't matter where the car gets inspected as long as its an ICBC approved inspection shop. They said it doesn't sound right that they're making people go to the dealership for these inspections.

IIRC one situation from the top of my head was that Monika girl? The one with the white Jeep who got her car inspected at some shop that was approved but given a VI again because she didn't go to the Jeep dealership?

There's plenty of people who got VI'd again because they didn't go to the specified [BRAND] dealership noted on their Notice and Order. But yeah, Monique is one of those people. There's also people who did go to the specified dealership and still got their VI sticker ripped off.

Friend at RCMP said that the whole issue lies with the shops. There are shops out there who are approving people whose cars are not up to par with the MVAR. So the police can't trust the inspection sticker. I argued that it's not their job to enforce the shops - it's ICBC's jurisdiction. It was made clear to me that it is a provincial act and under the offenses act, police officers (POs) have jurisdiction to investigate the shops.

While my friend's opinion is that it is not justified that Cain & Co harass shops and rips VI stickers off, with the above can see why it is done. Furthermore, apparently it states specifically in the MVA/MVAR that POs can designate inspection facility (IF). POs really shouldn't be ripping off VI stickers, but if it is clear that the vehicle does not comply with the MVAR, either the owner made changes after inspection or the IF is negligent or purposely cleared vehicles that do not conform to the MVAR.

I also asked if the PO can designate IF, wouldn't that be conflict of interest? It is only a conflict of interest if the PO(s) has a vested stake/interest in the shop. Which at that point it becomes breach of trust or corruption - IIO jurisdiction (the people that investigate cops).

cywinr 10-28-2019 09:18 AM

If we want to argue the merit of the VI's, they're mostly valid according to the MVAR. There are areas where it is clearly not specific enough (such as measuring db levels), but like many laws, there needs to be room for law enforcement to use their judgement. If we try to argue against the MVAR and the specifics of each VI, we will lose every time.

Instead, the argument should be whether or not we are being judged fairly. That means whether the severity of the punishment is equal to the severity of the infraction.

Does a stock lambo deserve a VI when there isn't realistically anything the owner can do other than change their driving behaviour? Probably not. Does he deserve to get a ticket for excessive noise? Probably yes. Was the owner driving normally or in race mode and revving unnecessarily?

Does a modified car deserve a VI if the owner fails the db test when pulled over and forced to rev their engine with the measuring device extremely close to the exhaust? Technically yes, if it exceeds 93db in any case, then it's not compliant. We can't argue against that. I'm not sure if we can even argue we are being discriminated against based on our vehicle that's the entire point of the MVAR. The best way to enforce those regulations is to target vehicles that don't look, sound, or even smell, compliant.

Regardless, Cain doesn't care about any of that. He just targets anyone that he thinks he can fail and blatantly "hands out VI's like candy". That may be something we can argue against. It's a tough case to make and we don't have a lot to work with on our side.

Maybe if a stock Toyota Corolla could fail his decibel test, perhaps we have a case to argue we are being discriminated against?

They're are targeting vehicles like a (probation officer)

monitoring VI offenders to verify they live up to the conditions of their OEM Specs and returning them to the dealers if they violate any conditions. Assess an offenders risk of re-offending and needs related to offending behaviour, linking both to a case management plan.

Does anyone have a copy of the cvse manual or can look up if the decibel noise for exhaust is different from the MVA regulations table.

The CVSE regs doesn't have anything like that in it -- at least, none that I can find. All it says is basically along the lines of "at the discretion of the inspector" as to whether it is too loud.
