You guys have to keep in mind that this is the same asshole who's stripping plates and towing cars that are oem spec or close to it for box 1 because of minor things like exhaust and window tint mods, while at the same time giving only a box 2 for that doczilla #whatsnext LB gtr that is 999x more modded and non compliant with mva How the fuck does that even make sense? Just one of the many examples why I think this guy is unfit to be in any profession with authority just because he practices the law all based on his own opinion |

I'm in a lot of contact with police(Burnaby RCMP) at my current job. They usually end up staying and talking for 20-30 minutes depending on the day. I've talked to them about this whole VI thing, asking if they're having some sort of crackdown themselves. All of them (3) said no. I mentioned the whole thing with VPD and how they're making people go to specific dealerships. All of them said it shouldn't matter where the car gets inspected as long as its an ICBC approved inspection shop. They said it doesn't sound right that they're making people go to the dealership for these inspections. IIRC one situation from the top of my head was that Monika girl? The one with the white Jeep who got her car inspected at some shop that was approved but given a VI again because she didn't go to the Jeep dealership? |

So the police can't trust the inspection sticker. I argued that it's not their job to enforce the shops - it's ICBC's jurisdiction. It was made clear to me that it is a provincial act and under the offenses act, police officers (POs) have jurisdiction to investigate the shops. While my friend's opinion is that it is not justified that Cain & Co harass shops and rips VI stickers off, with the above can see why it is done. I also asked if the PO can designate IF, wouldn't that be conflict of interest? It is only a conflict of interest if the PO(s) has a vested stake/interest in the shop. Which at that point it becomes breach of trust or corruption - IIO jurisdiction (the people that investigate cops). |
If we want to argue the merit of the VI's, they're mostly valid according to the MVAR. There are areas where it is clearly not specific enough (such as measuring db levels), but like many laws, there needs to be room for law enforcement to use their judgement. If we try to argue against the MVAR and the specifics of each VI, we will lose every time. Instead, the argument should be whether or not we are being judged fairly. That means whether the severity of the punishment is equal to the severity of the infraction. Does a stock lambo deserve a VI when there isn't realistically anything the owner can do other than change their driving behaviour? Probably not. Does he deserve to get a ticket for excessive noise? Probably yes. Was the owner driving normally or in race mode and revving unnecessarily? Does a modified car deserve a VI if the owner fails the db test when pulled over and forced to rev their engine with the measuring device extremely close to the exhaust? Technically yes, if it exceeds 93db in any case, then it's not compliant. We can't argue against that. I'm not sure if we can even argue we are being discriminated against based on our vehicle that's the entire point of the MVAR. The best way to enforce those regulations is to target vehicles that don't look, sound, or even smell, compliant. Regardless, Cain doesn't care about any of that. He just targets anyone that he thinks he can fail and blatantly "hands out VI's like candy". That may be something we can argue against. It's a tough case to make and we don't have a lot to work with on our side. Maybe if a stock Toyota Corolla could fail his decibel test, perhaps we have a case to argue we are being discriminated against? |
