What happens if you’re 25% at fault? (ICBC determination)
 
Parking lot accident, ICBC rated us 25% at fault. Any impact out of a determination like this? Future premiums, decision, or anything like that?

Edit: Backstory is my mom was backing out of a parking stall with nothing behind her or in lane coming at her. Car had passed by before she started moving, the other party was starting to turn right into another aisle. They suddenly changed their mind, popped it in reverse, and started backing up real quick. Our car was well behind them at that point so pretty evident they didn’t check beforehand. Mom stopped her car and started honking pretty much right away, but the other car ended up nailing our rear bumper sideways.

Pretty much looking at this like how the hell do you expect someone to randomly back up without checking and they’re the ones that were going forwards, suddenly stopped, and decided to back up with a car behind them. So at this point we’re still annoyed at the 25%.

I've never heard of that, what's 25%? I thought it was 0% 50% or 100%

Pretty much ICBC says they determined we’re 25% at fault, and 75% on the other party. It happens on occasion. I know with 50% or over pretty much your premiums get hit; ICBC says 25% does nothing except make you pay some deductible but wanted to check and make sure there’s something I’m missing

Isn't it either you are at fault or you aren't. Not sure where the they even come up with 25%. Why not 35% or 40% lol

If I remember correctly, if you're at fault 25% or less then your premiums don't go up

You just pay 25 percent deductible that's it
No raise in premiums

25% is the magic number. Anything above that and your premiums go up.

That said, on a matter of principle, fight that 25% if you have the time. They pull this BS all the time.

I had a parking lot incident where someone drove into me while I was still and they deemed it 50/50 even after seeing the dashcam video. I said fuck that, get your supervisor to review it, and within 5 minutes the guy called me back saying how they were doing me a favour and now ruling 25% my fault and 75% the other guy. I told them again to pound sand as it was clear cut that I did absolutely nothing wrong and within a few hours they emailed me saying I'm now 0% at fault. Fuck ICBC.

Yeah we tried and just decided to let it be this time. It's a hard push since we were still backing up till about a sec before impact. Too much other stuff to deal with, if it doesn't affect premiums it's good enough.

Actually...I guess it will come down to whether it will affect accident forgiveness

I knew someone personally who lost in court getting their 25% removed in a parking lot incident that wasn't their fault at all and they weren't moving like you and it call came down to the fact they didn't do "everything possible" to avoid the accident including honking the horn or trying to go in reverse.

Pretty fucking stupid, you shouldn't have to take action to stop someone from hitting you, onus should be 100% on the other person to be aware of their surroundings. Shouldn't need to be laying on a horn or doing something that's actually dangerous like going in reverse suddenly to make up for someone else's carelessness.
