if your logged in to live they can see if your playing the game offline.
if they see your playing the game offline and no store has broken street date in the area then you will likely be banned. its not instant
perhaps you missed what happened with forza3, mw2 is a huge title for MS since they have partnered with activision for advertising of mw2 & a limited edition console is coming out.
