If Apple had over 90% of the market (like Windows does on PC's) then maybe you could file antitrust, but with so many players in the smart phone market I just don't see anything coming of this.

Don't like lack of Flash on iPhone - buy another phone that supports it. Pretty simple. It's only when there's no choice available to the consumer that this comes into play. For example, Explorer coming pre-loaded on Windows machines.
