Why don't you try to develop games for the PS3 and then tell Sony "hey, I can't use xxx development tool or yyy software" and see how far you'll get. Or complain about the lack of support for a certain rendering technology.
Or call up Nikon and say you want to be able to save pictures in both Nikon and Canon RAW formats so you have a "choice".
"Software" is not the content like music and videos - it's the actual software used by the computer processor in the (TV/MP3 player/Blu_ray player/Refrigerator) to operate it.

I can buy a Intel CPU and use non Intel motherboards and chip sets. I can buy a Windows OS and install it on any make or model computer including Apple. I can't legally by OSX and install it on a non Apple computer.
Apple also banned the use of automatic translation tools so you have to make 2 different versions of the software.
