Ya that's the great thing about the apple store. They just take your word for it and give you a new one.
I was having proximity sensor issues with my iPhone 4 where my face would hit the buttons during a call every now and then. If was difficult trying to make the problem appear so naturally the apple guy couldn't either but said there must be a problem or I wouldn't be there.
