^#1 is NEVER buy one from a smoker. The gunk from them smoking gets in the 360, gets everywhere, and builds up. It's seriously fucking disgusting to open one up that has been owned by a smoker.
#2 don't buy one over 2 years old (check the build date on the back). Even if the console is registered to someone else, you can phone in and have them transfer the serial number over to you, and you can now warranty it should anything happen.
#3 double check the warranty label, just pop the faceplate off, there's 2 different labels, use google to see what they look like.

technically yes, but the "issues" with the PS3 are down around 3% or something, and for the most part, only with the one, very hot, model of PS3 (the old B/C 80GB). Of those that break, most of the YLOD is caused by the owner not providing sufficient ventilation. Both the YLOD and laser problems can be easily fixed, so far I have had near 100% success with PS3's (albeit I haven't had to fix many), the only one that I couldn't fix had a fried temperature sensor.
