Considering the fail rating means ABSOLUTELY FUCK ALL, does it really matter? So someone goes through failing every post he sees - it doesn't affect the posters, or the price of gas, or global warming, or anything else except making that person look like a douche... so really, who cares?
FAILs should be returned, and made applicable to every member in every forum, simply because they're there for FUN. Use them if you want, don't use them if you don't, and if you get failed, laugh about it and suck it up like a big boy, because they mean ABSOLUTELY FUCK ALL.
