Bad luck is the main thing. On the end of the observer, it would be warranted, because he doesn't see it while strolling the lot. However, being forced to pay because he was lining up to get a ticket is ridiculous.
I didn't read back a few pages, so I'm not sure how that case ended, but what I would have done is to get revs to get it cleared up. Hell, ask them about their security footage. Pretty sure they would have a camera towards the counter.
