VANCOUVER (NEWS1130) - The Employee Action Rights Network is giving out its Bad Boss Award and the latest winner is Bon's Off Broadway.

EARN says sworn affidavits from one current and one former employee say the owner doesn't pay minimum wage and doesn't offer vacation or overtime pay.

"One of the ways the costs are so low or the prices are so low perhaps is that people aren't being paid what they're legally entitled," says EARN's Stephen Von Sychowski. "We want to highlight the real cost of a $2.99 breakfast, which in this case, unfortunately, appears to be the rights and entitlements of the employees who work here every day."

Bon Wong is accused of paying servers $6 an hour from the till, an allegation he denies.

"Their side of the story right? Just a couple of the staff that got let go, that's their accusation," says Wong, insisting he pays minimum wage but admitting he takes $2 an hour from each server as a tip out for bussing tables.

Wong is also accused of not handing out paystubs, T4 forms, and records of employment. One affidavit says the employee worked 11 or 12 hour days and was not paid overtime. The other says on more than one occasion, the worker was called in to work and sent home after one hour without being paid the minimum four-hour daily call out.

Worker Christine Cayer says Wong has always been good to her. "I wouldn't be here almost 17 years working for him if he was a bad boss."

The inaugural Bad Boss Award was given last year to Anil Dhawan, the owner of three Subway restaurants in Vancouver.
