Sorry for the proportions, the space inbetween the parked car and the car with the door open is obviously a little tighter.
The smart car/bike is trying to turn right, and can fit in between the idle and parked car. The green line jutting out of the second idle car is a rear passenger opening the door therefore causing the bike/smartcar to hit it.
For some reason in my head I can see a bike being at fault/5050, but a smart car not being at fault. But if I say a smart car is not a fault then why the hell would a bike be? |
I would say the bike would be at fault...I can honestly say that I lane split when speed is idle or slow, but if anything were to happen, it would definitely be the rider's fault
