I've seen 49cc scooters pulled over and it's because they were going beyond their capable speeds as intended.
Does it happen often? No, not to my knowledge but I've seen it happen. Is it worth it? That's your own judgement call. Upgrades on a 49cc are a big fat waste of time and money, IMO. Just man the fuck up and get your class 6 and a real bike. Again, my own opinion.
