If you believe in penalizing based on the injury, then it's fair. IMO that's the worst way to assess a penalty.
Lumberjacking Kessel-style is the biggest bitch move in all of hockey IMO, well maybe just a bit better than spear to the balls. I think most people are willing to give him the first swing as 'self defense'. The second swing when Scott was already engaged with somebody else was boneheaded, and he'll admit as much. The final spear well after the fact, when his boy Clarkson was already taking care of business, just shows how much of a little twat Kessel really is. And he justifies it by saying "I'd like to see what you would do"
