ICBC will be paying for the damages either way. Once RCMP is involved, I don't think you can just get the person to "pay the bill".. because now ICBC is involved. Granted now the OP won't need to pay the deductible.
It seems the OP might want to spend free deductible on some de escalation training. Getting spat on is one thing.. spitting back basically takes away your credibility in court.

I agree on that I am 45 and still having difficulty to turn the other cheek. Patience is a good virtue. Hopefully he wont spit back when he is 45.
