In a comprehensive claim, the OP will need to pay ICBC the deductible regardless.

If the person is caught, charged criminally and then convicted, the judge may order the person to pay restitution back to ICBC (the cost of the repairs) and to the OP (the deductible).

If the person is not charged criminally and/or convicted, the OP can choose to pursue the cost of his deductible from the person through small claims court.
