^icbc may elect to pursue the guy for their costs and if they recover, the "victim" would get his deductible back. The kid doesn't need to be convicted criminally for a civil case. Standard of proof is a lot lower in civil court, as judgements are made on the "balance of probabilities" not "beyond a reasonable doubt" like they are in criminal court.

They may be able to put it under his liability policy, just depends how far they are willing to stretch the definition of "use and operation of a motor vehicle"
