actually it may matter if it's stupid. depending on when that covenant was written, it may no longer be valid.
for example, many convenants and liens on many properties were written 40 + years ago, at a time when these convenents and liens did not adhere to modern "laws".
for example, back in the day, many land titles acts and convenants restrict Asians, East indians and blacks from owning land, so that the neighbourhoods remain white neighbourhoods. It's too costly to actually change many of these titles/ covenants and right of ways so they are still there. But if anyone ever tries to enforce these convenants, they would automatically lose as a modern court would say it's against the charter or some sort of human/civil or racial rights act etc.
