As for liability, it isn't it kind of same as Skytrain?

If Translink(owner) was not following manufacture's recommended maintenance schedule and caused an accident, I bet people will be suing Translink.

If the train speeds up instead of braking due to manufacture's defect, I bet the manufacture will be held responsible for the accident.
