Even to an arbitrator, it is perfectly reasonable to explain that your family has run into financial difficulties, and therefore needs a larger income per month thus your family needs to move downstairs and therefore require the basement suite. However, the rights of first refusal I'm not so sure about, whether or not your existing tenant gets first dibs.
