Update: Vancouver man jailed 3-1/2 years for using date-rape drug in sexual assault

"VANCOUVER — A Vancouver man who drugged and raped a woman during a date last summer has been sentenced to 3-1/2 years in prison.

Seyed Nima Razavi Zadeh, 33, was convicted of sexual assault and administering a stupefying drug (GHB) for the purpose of enabling sexual assault. He pleaded guilty before his trial to two breaches of a recognizance.

Zadeh was sentenced in provincial court in Vancouver on Tuesday.

According to the written reasons for sentence, Zadeh met the victim, identified as J.C., at the Lower Mainland restaurant where she worked as a server in July 2014.

He suggested they go on a date and she gave him her phone number. A few days later, he proposed that they go out on July 11.

Zadeh picked J.C. up and they planned to go for drinks. However, he said he wanted to stop by his apartment first to change his clothes.

At Zadeh’s apartment, he offered J.C. a drink. She had a gin and tonic, which he prepared, and then he offered tequila shots. J.C. accepted. She noticed that one of the shooters tasted salty, but didn’t think much about it.

J.C. felt impaired soon after drinking the salty-tasting tequila shot. Zadeh followed her onto the balcony and touched her vaginal area over her clothing. Later in the evening, he brought her into his room and had sex with her as she went in and out of consciousness.

J.C. woke up at about 5:30 a.m. and left the apartment. She went home and then to the police to report the rape.

The police arrested Zadeh and searched his apartment, where they found GHB in a tequila bottle and in an energy drink.

According to a pre-sentence report, Zadeh has struggled with alcohol and substance abuse. He began experimenting with GHB in 2011 after the death of a close friend and has a history of depression.

During his 351 days in custody, he has been assaulted three times. The most recent assault, in July, took place after someone left an article about Zadeh’s offence in the general population. Zadeh suffered severe facial fractures and still has nerve damage.

Judge Gregory Rideout took Zadeh’s personal circumstances and recent assault into consideration, along with the victim’s concern for her personal safety and lack of trust in men.

Rideout sentenced Zadeh to 3-1/2 years in prison for the drugging and assault, minus 18 months of credit for time served, leaving two years in his sentence. He was given a suspended sentence for the breaches, and three years of probation.

Conditions of his probation include abstaining from drugs and alcohol, having no contact with the victim and abstaining from contact or communication with any adult female in a private place unless an immediate family member is present or he has written permission from his probation officer.

Zadeh is also the subject of a civil forfeiture proceeding. The B.C. Civil Forfeiture office is trying to seize Zadeh’s condominium — which he signed over to his mother for $1 — because the property was used “as an instrument of unlawful activity.”

A notice of civil claim filed in July alleges that Zadeh used the apartment for a sexual assault on a prior occasion, but charges in that case were stayed."
