No you don't have to be at fault or negligent. It depends on which bylaws are in place. The standard bylaws simply say the owner has to be responsible (not negligent) for the strata corp to sue back for the deductible.

Many stratas put their own bylaw in place allowing them to charge the deductible without having to sue. In that case, it comes down to the wording of the bylaw. Some specifically say negligence, some don't.
